C11 allows you to get a business Entrepreneur Work Permit in Canada via creating your own employment by establishing a new business, buying an existing business or even entering as a professional freelancer.

It means that you can enter Canada with a Work Permit under various scenarios:

  1. You purchase an existing Canadian business
  2. You invest in an existing Canadian business to become a major shareholder – 50+ % owner.
  3. You create your own new business in Canada.
  4. You relocate as a service provider, such as self-employed consultant, etc. There is no need to incorporate the business under this scenario. 

    What are the characteristics
    of C11 category:

    • Temporary nature of business or of your presence in Canada: Any business you plan to establish in Canada should clearly specify that your presence in Canada would be of a temporary nature. It means that even if the business is continuous and not seasonal, which means that it will remain operative in Canada after your departure, you would take steps to hire and train Canadians to run the business and replace you. You can remain the owner, but you need to show that within 24 months of operation, the business will be able to continue without your physical presence in Canada. It does not mean that you would leave Canada in 24 months, but it is very important to be approved under this category for the first time.
    • Type of business: Your business idea should not necessarily be innovative or unique and you are not required to make a specific amount of investment into the business to qualify for the program. The business investment is based on your business idea and business needs. Practically any kind of business except passive investment may be eligible.
    • Under scenarios number 1 and 2: Desjardins Lawyers will assist you preparing a comprehensive business plan to be filed to the Immigration Authorities, together with your  conditional agreement to purchase a business.
    • Under scenarios 3 and 4: Desjardins Lawyers will assist you prepare a comprehensive business plan outlining funds required and detailed steps to realize your project.
    • Your background: Your business idea should be related to what you are good at. Even if you never owned a business and always worked as a salaried employee, it does not prevent you from using this program.

    As a foreign entrepreneur, you may become eligible to apply for Canadian permanent residency after operating your business in Canada for at least
    12 months!

    We recently secured a C11 approval for our client and he will be relocating to Canada within a couple of months.

    Our client will travel to Canada with his wife and 3 minor children. While the principal applicant will be issued an Entrepreneur work permit, his spouse will be eligible for an open work permit, allowing her to be employed by any Canadian employer in any capacity. Their children will be entitled to study permits for the same duration (up to 2 years).

    The client established a new company in Canada, and he plans to become an exclusive distributor of building materials. The company plans to achieve this by building a strong network of distributors and partnering with key players in the industry.

    In support of his business intent, our client signed Memorandums of Understanding with distribution companies, which were disclosed in his application and presented to the Canadian Immigration Authorities. He has also demonstrated that he owns the assets required for the company development. The client has full control of amounts to invest as well as the timing of investments.  

    This client has some prior business ownership experience. However for the past number of years he was working as a salaried employee. As you may see, it did not prevent him from securing a positive decision under the C11 category.
